Some might say that modern insolvency law offers the best means for restructuring. But not according to us. We only pursue this path if it is sensible and avoidable. Insolvency creates uncertainty among employees, customers, suppliers and, not least, the entrepreneur. Restructuring without insolvency is therefore often the better way. For this, it is important to think in a business manner, but without overlooking legal implications. We focus on both aspects. Together with experienced business consultants, we find solutions to prevent insolvency.

If restructuring looks unpromising without resorting to insolvency means, we will utilize judicial procedures: Procedures as “Schutzschirmverfahren”, self-administration and regular insolvency proceedings. We advise companies and managers or act as solicitors. However, it is important to us that these functions are always performed separately. Even a mere consultation will prevent us from serving as insolvency practitioner or solicitor. Courts trust us to conduct our services transparently and properly. Only collaborations with local courts based on trust allow restructurings to be successful.
Our partners are regularly appointed as insolvency practitioners from the local courts of Düsseldorf, Mönchengladbach and Wuppertal and are recommended as administrators or trustees at courts across Germany (Sections 56a and 270b of the German Insolvency Code).
Irrespective of the type of procedure, our priority is always the restructuring of the company and the preservation of value and jobs.
We implement restructurings under labor law, find mutual solutions with transfer companies and negotiate with works councils and unions. We always approach negotiations by trying to find a consensus. Disputes create resistance that prevents creative solutions. If jobs reductions are unavoidable for saving a company, we will provide you with legally methods of implementation.
